Hold Harmless, Release of Liability, Indemnity and Assumption of the Risk: BlockOut Volleyball Academy LLC undertakes the responsibility to provide you/your child with expert volleyball skills and athletic training, and other related services. By signing below, you acknowledge and agree to the following: You represent that you/your child is physically fit to participate in the BlockOut Volleyball Academy's Program, and that prior to participation you have consulted with a physician regarding any limitations or medical risks that you/your child may have in relation to the programs and certify that you/your child are free from such limitations and medical risks. You further understand and agree that BlockOut Volleyball Academy's program involves physical exertion and strenuous physical activity by the participant, which entails certain risks, serious bodily injury and/or death may occur. For example, physical contact with other participants, equipment or surfaces may occur during the "Program." With full knowledge of the risks of serious bodily injury and/or death, you/your child voluntarily chooses to participate in BlockOut Volleyball Academy's Program and (i) hereby forever release, covenant not to sue, discharge and waive all liability on behalf of BlockOut Volleyball Academy's Program, its employees, executives, agents, affiliates, owners, subsidiaries, partners, sponsors, owners and lessees of the premises, consultants, volunteers, and contractors (the Releasees) for any bodily injury of any kind, property damage or death, suffered by you as a result of your participation in the "Program," regardless of whether such bodily injury or death was due to negligence of any kind committed by BlockOut Volleyball Academy or the Releasees or otherwise (ii) agree to indemnify and hold harmless BlockOut Volleyball Academy and the Releasees from any loss, liability or cost they may incur arising out of or related to you/your child's participation in the "Program", and (iii) assume full responsibility for any bodily injury, death or property damage arising out of or related to you/your child's participation in the "Program." Notwithstanding your agreement not to sue BlockOut Volleyball Academy and the Releasees, you agree that any legal proceedings of any kind, including those related to the enforceability of this waiver, shall take place in Jefferson County, Alabama. You certify that you have read the foregoing and understand that by signing below, are giving up certain legal rights and remedies and intend that your signature be a complete and unconditional release of all liability on behalf of BlockOut Volleyball Academy and the Releasees to the greatest extent permitted by law.
MEDIA RELEASE POLICY AGREEMENT:BlockOut Volleyball Academy owns several social media accounts including but not limited to Instagram, Facebook, Twitter, TikTok, website, etc. BlockOut Volleyball Academy may develop, participate in, or be the subject of media based productions and events which highlight various educational activities, training, classes, workouts, games, etc. throughout the year. These media based productions are of two types. Those produced by BlockOut Volleyball Academy's owners, staff, agents, assistants, workers and the like and then those taken by commercial media outlets. BlockOut Volleyball Academy, its owner(s), staff, assistants, workers, agents etc. may create photographs of students and activities, slide or tape presentation, video tape of athletic practices, training sessions and athletic events, computer generated presentations which may incorporate scanned pictures, jpeg files, and video clips, computer based productions transmitted via the internet and telecommunications. These media based productions may be used by BlockOut Volleyball Academy for promotional, recruitment, teaching and instruction, and various other purposes for the growth and promotion of BlockOut Volleyball Academy and our athletes. These media based productions may be used on BlockOut Volleyball Academy's social media outlets, website, newspapers, news media outlets, print media, television and radio media outlets. The Media Release Policy Agreement allows you/your child to be involved in any media related activities. This may include work or pictures that are published on the Internet, in the media, social media or in newspapers. However, BlockOut Volleyball Academy has no control of work or pictures that are published on the Internet except for their website, in the media or in any newspaper. My signature below indicates receipt of the Media Release Policy and that permission is granted for my child's picture/work to be featured in the media.
Rescheduling/No Show Policy: Consistency and repetition is the most important thing for any profession. Attending your training sessions jump starts your improvement, transformation and gets you closer to mastering your volleyball skills.The time slots are especially reserved for you and practice sessions are custom made to the group of a selected few or to an individual. We understand that sometimes schedule adjustments are necessary and we will try our best to accommodate those. We respectfully request for at least 48 hours for all rescheduling/cancellations.
All class cancellations must be done directly via email @ hello@blockoutacademy.com
Cancellation/Refund Policy - Class/Private Lessons: Any cancellation within less than 48 hours of the class/private lesson will result in loss of session with no refund and no credit. If a cancellation is prior to the 48 hour deadline, a maximum of 2 make-up classes will be allowed. Any make-up classes must be used within a month of the cancellation.
Cancellation/Refund Policy - Camps:
- 25% of tuition is forfeited if written notice is received more than 20 days prior to Session/Camp start date.
- 60% of tuition is forfeited if written notice is received between 7 to 14 days prior to Session/Camp start date.
- Cancellations received within 7 days prior to Session/Camp start date will forfeit full tuition.
- Requests for cancellation due to illness, accident, death in the family or moving requires documentation. Upon receipt of documentation, a refund will be issued minus the $25 administration fee. Verification must be received no later than 7 days after the scheduled Camp/ session date. Refunds will be issued in the same manner as payment was made. Any make-up classes must be used within a month of the doctor's release date.
- Any session that is not completed for whatever reason will be lost with no refund or credit.
Drop-Out Policy: If the athlete wishes to drop out, you are still financially responsible for the remainder of program tuition. If the athlete drops out due to injury, a doctor’s note is required to receive credit for the future lessons.
Fees: All Fees are due at the time of sign-up.
Annual Registration Fee: Effective 1.1.2020. Yearly registration fee of $95 dollars for single family athlete or $135 for multiple athletes from the same family will be applied to your account. This fee is required to register for any private lessons, group classes, clinics, or courses. Special events may not be subject to the yearly fee. I understand that the registration fee is not included in the price of the class and can be selected under plans at the time of checkout/sign up. The fee is valid for 12 months from the day of purchase.
Newcomer’s: All new athletes to the academy must initially select the Newcomer Plan. This plan allows the athlete to attend 3 drop-in classes before they are eligible to attend a single class. This allows the athlete to get past some of the intimidation of a new environment or sport and really see what BlockOut can offer them. Drop-in classes would be the clinics that are offered (Beginner clinic, Serving, etc). Drop-in classes do not include School of Volleyball, Spring Training or Fall Training.
Declined Credit Card/Returned Check Fee: All declined cards or returned checks will be charged a $35 fee. Please keep your payment information updated.
Payment Authorization(Program Members): I know that it is my responsibility to add and maintain a valid credit card on my account at all times. I understand that all charges for the monthly programs (School of Volleyball, Spring and Fall training) are billed to the athlete's statement by the 1st day of the month, and that a $35 fee will be assessed for all declined payments. I understand that if my card is declined on the 1st, not only will I be charged the $35 fee, I am responsible for making the payment by the 5th of the month. I also understand that if the athlete's account balance is delinquent, BlockOut may, in its sole discretion, deny further participation in BlockOut events by the athlete until the account is current or until alternative payment arrangements are mutually agreed upon. BlockOut is hereby authorized to initiate payment for all amounts billed to my statement through automatic credit card billing. I understand that BlockOut will initiate payment from my account/credit card on the 1st day of each month or at the time of the class/camp sign up for all the drop-in options.
Collections: If you have a balance outstanding for 90 days with no payment then your account will be turned over to collections. All statements are sent through email.
Emailed Statements: All statements are emailed to you. So make sure you check your emails. You are responsible for making sure the correct email is listed on your account. If you need to change it you may log in to your account and make any necessary changes.
Late Arrival/Pick Up Policy: Players are responsible for arriving on-time to their training sessions. Please arrive 15 minutes prior to scheduled class/clinic times. Being late affects your performance and group session flow. If the athlete is more than 15 minutes late of the scheduled training time, the coach is not required to lead the remaining time alloted for the individual session or allow the player to participate in a group session. Please notify your coach if you anticipate late arrival. Late pickups will not be tolerated. Late pickups will be charged at an hourly rate of $100 per hour, charged by the minute, unless the late pickup is approved by BOA admin or coach.
*PARENTS ARE RESPONSIBLE FOR THEIR CHILDREN BEFORE AND AFTER CLASS.
Attire: Please come to class 15 minutes early and ready to go: hair up, athletic shorts/shirts/leggings and a clean pair of gym shoes. (Volleyball shoes are highly encouraged.) Athletes without clean shoes will not be allowed to participate. No make-up.

Gym Closing Policy - Inclement Weather:In the event of inclement weather, BlockOut Volleyball Academy will generally follow Homewood School Closing Schedules. We will post closings on our social media and website, as well as, send an email to your email address you provided at registration. Only students registered for cancelled classes will receive an email. Make ups will not be offered if class is cancelled due to weather.
Government Mandated Shutdown: Please be assured BlockOut has no intentions of closing or cancelling classes unless required. But in the event of a government mandated shutdown, BlockOut will issue credit for any missed classes. No refunds will be issued. Make ups will not be offered if class is cancelled due to government mandated shutdown.
Housekeeping: Safety is a priority at BlockOut. Our coaches and staff are dedicated to the protection of our athletes. To help protect our athletes, the facility is cleaned on a regular schedule and our coaches practice the appropriate steps to prevent the spread of germs (hand washing hands, sanitizing, covering coughs, etc).
If your athlete is not feeling well please use your best judgement.
Force Majeure: In no event shall BlockOut Academy be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, strikes, work stoppages, accidents, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes or acts of God, and pandemics; it being understood that BlockOut Academy shall use reasonable efforts which are consistent with accepted practices to resume performance as soon as practicable under the circumstances. In an event of force majeure, including but not limited to those listed above, that requires BlockOut Academy to close, they may do so without any obligation to refund any portion of tuition paid.
Pandemic Situations: You acknowledge that BlockOut Academy is conducting classes despite health guidelines from the Center for Disease Control (CDC), Health Department, State Government and Federal Government.
You acknowledge you/your athlete is not required to attend classes at BlockOut Academy.
You acknowledge that you/your athlete are participating by your own free will.
You acknowledge that you/your child is physically fit to participate in the BlockOut Volleyball Academy's Program.
Participation at BlockOut is at the sole discretion of the parent.
You/your athlete are feeling well.
You/your athlete are not running a fever.
You/your athlete will not attend classes if any of these symptoms are present.
You acknowledge that BlockOut is following health recommendations set by public health official to help prevent the spread of the coronavirus:
BlockOut is encouraging athletes to wash hands frequently. All athletes are required to wash their hands before entering the gym, after class.
BlockOut is cleaning and disinfecting the gym daily or more, if needed.
BlockOut is disinfecting door knobs and common areas regularly throughout the day.
BlockOut has asked the parents and athletes not to gather in the waiting areas.
BlockOut is keeping the number of athletes in class to 10 or less.
You acknowledge that in the event you/your athlete does get sick you will not hold BlockOut Academy responsible. That you assumed all risk of attending classes.
Policy changes: I understand that BlockOut reserves the right to change the policies and terms of this agreement at any time. Any changes will be emailed out, available on your waiver, and on our website. I further understand that if I have any questions about the policies that I will email hello@blockoutacademy.com. I understand that I must have a Visa, MC, DISC, or Amex card (credit or debit) on file to stay enrolled in classes. I understand that my athlete will be moved to the appropriate level of their skills and that classes may be combined with another class for reasons deemed necessary to run effective classes.
ENTIRE AGREEMENT; AMENDMENT. The above terms and conditions of the BlockOut Volleyball Academy's Program constitute the entire agreement, and supersedes all prior agreements and understandings, both written and oral, with respect to the subject matter hereof. The Program Terms may only be amended by a writing executed by both parties.
